1. Agreement to Terms
These Terms and Conditions ("Terms") govern your access to and use of the website, software platforms, APIs, WhatsApp-based bots, applications, and professional services (collectively, the "Services") provided by Twinstar Innovations ("Company", "we", "our", or "us").
By accessing, registering for, communicating with, or using any of our products or services — including interacting with our WhatsApp bots — you acknowledge that you have read, understood, and agree to be legally bound by these Terms. If you do not agree, you must not use our Services.
2. Scope of Services
Twinstar Innovations provides:
- Software-as-a-Service (SaaS) platforms and tools
- WhatsApp-based automated bots and messaging services
- Web, mobile, and cloud-based applications
- Consulting, implementation, customization, and support services
3. User Accounts & Messaging Consent
Some Services may require account creation or authentication through third-party platforms such as WhatsApp. By initiating communication with our WhatsApp bot, you expressly consent to receive automated messages related to the Services.
You are responsible for maintaining the confidentiality of your credentials and for all activities conducted through your account or phone number.
4. WhatsApp Bot Usage & Data Consent
By interacting with our WhatsApp-based bots, you expressly authorize Twinstar Innovations to collect, store, process, and analyze the information you share through WhatsApp, including but not limited to messages, responses, metadata, and usage patterns.
This data may be used for:
- Providing and operating the Services
- Customer support and issue resolution
- Improving product functionality and user experience
- Analytics, reporting, and performance optimization
- Training, testing, and improving AI, ML, and automation models
You acknowledge that such data may be processed in aggregated and/or anonymized form. Twinstar Innovations does not sell personal WhatsApp data to third parties.
5. SaaS License & Usage Rights
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use our software and bots solely for lawful purposes.
You may not:
- Reverse engineer or attempt to extract source code
- Resell or sublicense the Services
- Use the Services for unlawful, abusive, or fraudulent activity
6. Professional Services
Consulting or implementation services will be delivered based on agreed scope. Delays caused by incomplete inputs or third-party dependencies are not the responsibility of Twinstar Innovations.
7. Fees, Payments & Subscriptions
Fees are billed as per the agreed plan or proposal. Subscription charges are non-refundable unless explicitly stated otherwise.
8. Data Protection & Privacy
You retain ownership of your data. By using our Services, you grant us the right to process your data in accordance with these Terms and applicable laws, including the Digital Personal Data Protection Act, 2023 (India), where applicable.
9. Intellectual Property
All intellectual property related to the Services remains the exclusive property of Twinstar Innovations or its licensors.
10. Termination
We reserve the right to suspend or terminate access if you violate these Terms or applicable laws.
11. Disclaimer of Warranties
The Services are provided on an "as is" basis without warranties of any kind, express or implied.
12. Limitation of Liability
Twinstar Innovations shall not be liable for indirect, incidental, or consequential damages, including loss of data or profits.
13. Indemnification
You agree to indemnify and hold harmless Twinstar Innovations from claims arising from misuse of the Services or violation of these Terms.
14. Modifications to Terms
We may modify these Terms at any time. Continued usage constitutes acceptance of the updated Terms.
15. Governing Law & Jurisdiction
These Terms are governed by the laws of India, and courts in India shall have exclusive jurisdiction.
